- Customer / you: the natural person or legal entity entering into an agreement with Brevox.
- Consumer: a customer who is not acting in the course of a profession or business.
- Products: the screen protectors and accessories offered by Brevox.
- Website: www.brevox.eu.
Article 2 — Applicability
- These terms and conditions apply to every offer made by Brevox and to every distance contract concluded between Brevox and the customer.
- Before the contract is concluded, the text of these terms and conditions is made available electronically, so that the customer can easily store it.
- Deviations apply only if they have been agreed in writing.
Article 3 — Offers and prices
- All offers are without obligation and apply while stocks last.
- Prices are in euros and include VAT for consumers; for business (B2B) customers, prices may be shown excluding VAT.
- Obvious mistakes or errors in an offer are not binding on Brevox.
- Shipping costs are shown before the order is completed. Brevox offers free shipping within the Netherlands on orders from €25 (retail); different terms apply to business orders.
Article 4 — The contract
- The contract is concluded at the moment the customer places the order and Brevox confirms receipt of it electronically.
- Within the limits of the law, Brevox may verify whether the customer is able to meet their payment obligations, and may refuse an order or attach conditions to it.
Article 5 — Right of withdrawal (cooling-off period)
- A consumer may cancel an online purchase during a cooling-off period of 14 days without giving reasons. This period starts on the day after the consumer (or a third party designated by them) has received the product.
- During the cooling-off period, the consumer shall handle the product and its packaging with care. The product may be unpacked and inspected as it would be in a shop; any reduction in value caused by use beyond this may be charged to the consumer.
- The consumer notifies Brevox of the withdrawal within the cooling-off period by email to sales@brevox.eu (optionally using the European model withdrawal form) and returns the product within 14 days thereafter.
- The direct costs of returning the product are borne by the consumer, unless stated otherwise.
- Brevox refunds the full purchase amount (including the original shipping costs) within 14 days of the notice of withdrawal, provided the product has been returned or the consumer has demonstrated that it has been sent back. The refund is made using the same payment method as the original payment.
- Exceptions: sealed products that cannot be returned for reasons of hygiene, and whose seal has been broken after delivery, are excluded from the right of withdrawal.
Article 6 — Delivery and performance
- Brevox ships from the Netherlands, usually with PostNL. Orders placed before 1:00 p.m. on a working day are delivered the next working day where possible; stated delivery times are indicative and are not strict deadlines.
- If delivery is delayed or cannot be carried out (in full), the customer will be informed as soon as possible. In that case, the consumer may terminate the contract free of charge if the statutory maximum delivery period of 30 days is exceeded.
- The risk of damage and/or loss passes to the customer at the moment of delivery.
Article 7 — Payment
- Payment is made using the payment methods offered on the website, processed by our payment service provider Mollie.
- The customer is obliged to report any inaccuracies in the payment details provided or stated without delay.
Article 8 — Warranty and conformity
- Brevox warrants that the products comply with the contract, the specifications stated in the offer and the statutory requirements (legal conformity). The consumer always retains the rights arising from the law.
- Any additional (commercial) guarantee provided by Brevox, the manufacturer or the importer does not affect the consumer's statutory rights. Where Brevox offers an extended warranty on the screen protector, the conditions stated with it apply.
- The warranty lapses in the event of improper or unintended use, or damage caused by the customer after delivery.
Article 9 — Complaints
- Complaints about the performance of the contract must be submitted to Brevox, fully and clearly described, within a reasonable time after the customer has discovered the defect, by email to sales@brevox.eu (or info@brevox.eu).
- Brevox responds within 14 days of receiving the complaint; if a longer processing time is needed, the customer will receive an indication of when to expect a reply.
- Consumers may also submit a complaint via the European ODR platform: https://ec.europa.eu/consumers/odr.
Article 10 — Liability
- Brevox's liability is limited to the amount of the order concerned, except in cases of intent or gross negligence and except where mandatory law provides otherwise.
- Brevox is not liable for indirect or consequential damage.
Article 11 — Personal data
Brevox processes personal data in accordance with the Privacy Policy and the General Data Protection Regulation (GDPR).
Article 12 — Governing law and disputes
- All contracts are governed by Dutch law.
- Disputes will be submitted to the competent Dutch court, without prejudice to mandatory rules of jurisdiction for consumers.
